Terms and Conditions – Monte Beau

Welcome to Monte Beau. This website is operated by JS Stratenmaken, a Dutch company registered with the Netherlands Chamber of Commerce, trading under the name MonteBeau. Throughout the site, the terms "we", "us", and "our" refer to MonteBeau. MonteBeau offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our website and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms and Conditions, including those additional terms and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site.

Article 1 – Definitions

  • Cooling-off Period: The period within which the consumer can exercise the right to cancel.

  • Consumer: A natural person who is not acting for purposes relating to trade, business or profession.

  • Day: Calendar day.

  • Durable Medium: Any instrument which enables the consumer or trader to store information addressed personally to them in a way accessible for future reference.

  • Right to Cancel: The consumer’s right to withdraw from the contract within the cooling-off period.

  • Distance Contract: A contract concluded between a trader and consumer under an organised distance sales scheme without the simultaneous physical presence of the parties.

Article 3 – Applicability

These general terms and conditions apply to every offer from us and to every distance contract concluded between us and the consumer.

These terms will be provided prior to the conclusion of a distance contract. If not reasonably possible, you will be informed where they can be accessed and that they will be sent free of charge upon request.

If the contract is concluded electronically, we will make the terms available in a format that can be stored and reproduced.

If specific product or service conditions apply, the most favourable term for the consumer shall apply in the event of conflict.

Article 4 – The Offer

  • Offers are non-binding and subject to availability.

  • Product descriptions and images are accurate to the best of our knowledge but may not perfectly reflect the actual item.

  • Prices are shown exclusive of any applicable customs duties or import VAT for international orders. These are the customer’s responsibility.

  • Shipping costs will be clearly stated at checkout.

  • Details of how the contract is formed and payment methods will be explained during the order process.

Article 5 – The Agreement

The contract is concluded when the consumer accepts the offer and meets the conditions set.

When a consumer accepts an offer electronically, we will confirm receipt promptly by email. Until then, the consumer may cancel the agreement.

We reserve the right to decline orders based on legal compliance or commercial assessment. If declined, we will inform the consumer and refund any payments received.

Upon delivery, the consumer will receive all relevant information including withdrawal rights, complaints procedure, warranty conditions, and contact details.

Article 6 – Right to Cancel

Consumers in the UK have the right to cancel their purchase within 14 days without giving any reason. The cancellation period starts from the day the goods are received.

To exercise the right, you must inform us via email at info@montebeau.com. You then have 14 days to return the goods in their original condition and packaging.

Additional 24-Hour Cancellation Policy (Before Shipment)
In addition to your statutory rights, we offer a 24-hour cancellation window after your order is placed. During this time, you may cancel your order for a full refund — provided the item has not yet been dispatched.

Please note:
If you request cancellation after this 24-hour period and the item has already been shipped, the order cannot be stopped in transit. However, you are still entitled to return the item after delivery under the standard 14-day return policy mentioned above.

Article 7 – Return Costs

The cost of returning items is borne by the consumer. Upon valid cancellation and return, we will refund the full amount, including standard delivery charges, within 14 days.

Article 8 – Exclusions to the Right to Cancel

This right does not apply to:

  • Customised or personalised items;

  • Sealed goods unsealed after delivery which are unsuitable for return due to health protection or hygiene reasons;

  • Perishable goods;

  • Digital downloads after download has begun.

Article 9 – Pricing

  • All prices are in GBP (£), inclusive of UK VAT where applicable.

  • MonteBeau is a trading name of a Dutch company; UK customers may be liable for import VAT and customs fees.

  • We reserve the right to amend prices due to legal changes or obvious errors.

Article 10 – Conformity and Warranty

We guarantee that our products conform to the contract, the product description, and legal standards. Claims for faulty or incorrect items must be made within 14 days of delivery.

Article 11 – Delivery

We deliver to the shipping address provided during checkout. Delivery will occur within 30 days unless agreed otherwise.

In the event of delays, unavailability, or partial fulfilment, the customer will be informed and may cancel the contract.

Risk passes to the consumer upon delivery.

Article 12 – Duration Contracts and Termination

  • Contracts for ongoing services may be cancelled by the consumer with a maximum one-month notice period.

  • Auto-renewals are not permitted unless explicitly stated and agreed.

Article 13 – Payment

All payments must be made within 7 working days of order confirmation unless otherwise agreed. Failure to pay may result in order cancellation.

Article 14 – Complaints Procedure

Please send complaints to info@montebeau.com. We aim to respond within 14 days.

We are a Dutch-based business and will attempt to resolve all disputes amicably. For UK consumers, we comply with the Consumer Contracts Regulations and applicable EU/UK dispute resolution mechanisms.

Article 15 – Disputes

These terms are governed by Dutch law. However, if you reside in the UK, you may also bring legal proceedings in your local courts under UK consumer protection laws.

Article 17 – Errors and Omissions

We reserve the right to correct errors, inaccuracies, or omissions and to cancel orders if necessary due to inaccurate information.

Article 18 – Changes to These Terms

We may update these terms from time to time. You are encouraged to review them regularly. Continued use of our site constitutes acceptance of any changes.

Article 19 – CESOP and Payment Transparency

In accordance with EU regulations on the Central Electronic System of Payment Information (CESOP), your payment data may be recorded by payment service providers for cross-border transparency.
